Divorce - How to Determine When a Couple is Officially Separated?

One of the more important determinations in any divorce case is establishing when the parties have officially separated. Establishing a date of separation is key to determining the value of the parties' marital assets and for ascertaining when the court may issue a divorce decree if both parties do not consent to the divorce. As a divorce attorney, clients are often confused as to when the date of separation actually lies.

Marriage and Divorce - The Role of the Husband

This is what the Bible says concerning the role of the husband, Ephesians 5:23,25,28,31. "A husband is the head of his wife, as Christ is the head and Savior of the church, which is His own body. A husband should love his wife as much as Christ loved the church and gave His life for it. In the same way, a husband should love his wife as much as he loves himself. A love who loves his wife shows he loves himself. As the Scriptures say, "A man leaves his father and mother to get married and he becomes like one person with his wife."

Inheritances - How Are They Handled in a Divorce?

As part of the job as a divorce attorney, I am responsible for delving into my clients financials in detail. When a client informs me that he or she has received or stands to receive an inheritance, the first question from him or her is always "can my soon to be ex take part of it?" As a rule of thumb, if you are left an inheritance (in your name only), it is not considered to be marital property and is not subject to be divided by the Court. It does not matter whether you received the inheritance during the marriage or if you only stand to receive it sometime down the road.
