In my practice, I prepare a significant number of wills & estates. Most people understand that the gifts that they make in a will or trust will pass to the person they desire upon the testator's death. However, it isn't always so clear when it comes to life insurance policies, Annuities, IRAs and 401(k)s.

Child Support After 18?!

I have written previously about the expiration of a child support order and have discussed that the order doesn't necessarily expire when the child turns 18 years of age. The recent case involving a New Jersey teenager suing her parents for support (among other things) casts a new light on the issue of parents providing support to their child. The Judge in the case denied the teen's request for immediate support in the amount of $650 per month but scheduled a hearing for April in which he will consider evidence and testimony to determine whether a parent is responsible for providing support to his or her 18 year old daughter - who they had previously kicked out of the house for failure to follow the rules.

Marriage and Divorce - The Consequences of Divorce

The consequences of how divorce affects the children are sometimes unintended. In my last writing, I stated that many children of divorced parents have to deal with many emotional issues, such as depression, rebellious behaviors and more.

Child Custody & School Districts

One of the primary concerns that Parents debate in child custody cases is which parent should have custody of the child on school nights. Now, there are a number of factors that go into determining which parent should have custody on those evenings including: which parent is more likely to help the child with homework, which school district each parent lives in, their proximity to the school and the availability of transportation to and from the school.

DOES A BULL STOCK MARKET MEAN IT'S TIME FOR MORE DIVORCES?

So the stock market is breaking new highs. One would think that the result should be happier home life as family portfolios start to bulge faster than Chris Christie's waist line, but the fact of the matter is that recent U. S. Census Bureau data shows that the divorce rate in the United States is skyrocketing. This revelation means one thing, instead of allowing money to assuage all wounds, couples are taking the opportunity to cash out when the going is good. And, because there's money in the coffers, there is money for the spouse who is leaving the marital residence to purchase a new house.
