Child Custody in a Divorce – Compromise or Court?

One of the most difficult issues to handle during a divorce is child custody. Parents that are getting a divorce have some hard decisions to make considering the future of their relationship with their children. For instance, now that we are going to live in separate homes, should we both live within the same school district? How many nights can I spend with the children considering my work schedule? Who should take the kids to soccer practice? I think that everyone can agree that these decisions are best left to the parents to decide.

As a Pittsburgh divorce attorney, I have seen too many instances in which parents allow emotions to become involved and divert their anger toward one another into a bitter child custody dispute. When parents to this, they surrender their ability to make decisions like the ones above and leave such decisions up to a Judge. While Judges do their very best to be impartial and carefully tailor their orders to serve the best interest of the child, a Judge only sees a small picture of the family’s life during hearings. Is this the person you want making determinations about how your family is going to live their day-to-day lives? The people that truly know the best way to manage decisions regarding their children’s health, education, faith and other important issues are the parents. Any parent going through a custody dispute should consider this carefully when deciding whether or not to devise a custody arrangement between themselves or take the battle to court.
